I am a retired LVN. I am now disabled. 4 CVA's leaving me with numerous neurological problems AND the need for supplemental 02.

I was pulled over by the Texas DPS. I had not been drinking and have witnesses. I did however explain that I could not perform the test having only 20% lung capacity. I also could not do the heel to toe walk test. I was taken to jail with my 02 in hand. I was telling the jail nurse that I would be out of 02. I began telling him 2 hours before I knew I would run out. He kept telling me that it was my problem and not his. To make a long story short I ran out of 02. After 20 minutes I passed out. I revived sometime later after I was recieving 02.

I'd like some second opinions. I have an attorney and my doctor to handle the DWI accusation. Even innocent I must go thru the chain of the courts. What I would like to know is your opinion on the jail nurse not securing me 02 before I ran out.

Personally I think he was negligent. I would have never in a million years allowed that to happen to anyone on my watch.

What do you guys think? Should I file a complaint with the state board of nursing? Question

I would make sure that it did. The keys here being that the nurse DID NOT do what any reasonable nurse would do in the same situation and that harm did come from this--you lost consciousness. You were obviously already on O2. It would be the same as a diabetic with a medic alert tag not being allowed to have his insulin or have something to eat. The condition is publicized, any reasonable nurse would make sure it is addressed.

I hope you report it, you are lucky to be revived. I cant understand why someone would do that to anyone! I am glad you are OK.
